GENERAL CONDITIONS OF SALES AND USE OF C2CARE SERVICES
1. Company Introduction C2Care
The company C2Care is a Simplified Joint Stock Company with share capital of €558,047.88, registered with the Toulon RCS under number 815 196 332, whose head office is located at 101 avenue Desmazures, 83110 Sanary-sur-Mer, France.
2. Definitions
C2Care: designates the company publishing the Service, hereinafter referred to as “C2Care”.
User: any natural or legal person who has subscribed to one or more C2Care Services.
Service: set of services offered by C2Care including software access (via virtual reality headset and/or web browser), the possible provision of equipment and support from a practitioner if necessary.
Subscription: contractual commitment between the User and C2Care for one or more Services.
Equipment: equipment possibly made available to the User by C2Care (headsets, controllers, tablets, etc.).
Partner Practitioner: health or well-being professional authorized to carry out remote sessions as part of the Service provided by C2Care.

3. Purpose and scope of the General Terms and Conditions
These General Conditions of Sale and Use (CGVU) govern the conditions of access, use and invoicing of the services offered by C2Care, whether free or paid.
Their purpose is to define the contractual rights and obligations between the company C2Care and any User who has subscribed to the Service, including in the context of free access to the platform.
The simple fact of registering for the platform, whether via a free plan or a paid subscription, implies full, complete and unreserved acceptance of these General Terms and Conditions, accessible at any time at the following address: https://c2.care/en/cgv-en.
These General Terms and Conditions take precedence over any other document, communication or purchase condition emanating from the User.
C2Care reserves the right to modify these General Terms and Conditions at any time. The applicable version is that in force on the date of Subscription or, in the event of subsequent modification, that in force at the time of continued use of the Service by the User, this use being deemed tacit acceptance of the new conditions.
4. Description of the services offered
The Service offered includes:
- Access to a software platform allowing virtual exposure situations in immersive environments
- Artificial intelligence (AI) functionalities to support the User
- Optionally, the provision of compatible equipment
- Optionally, video sessions with partner practitioners
The Service is intended to improve emotional well-being. It does not in any way constitute a medical treatment or therapeutic act.
5. Subscription conditions
Subscription to the Service can take two forms:
Access without financial compensation: the User can access certain limited functionalities of the Service without payment. This registration implies full acceptance of these General Terms and Conditions.
Access with paid subscription: the User can choose a paid plan, including extended functionalities, additional services (equipment made available, video sessions, etc.), with or without commitment. Subscription is made via the https://app.c2.care website or through a C2Care advisor.
Formulas with provision of equipment imply a duration commitment specified during Subscription. All paid subscriptions are tacitly renewed unless otherwise specified in the offer or quote.
6. Use of the Service
The Service can be used:
- For oneself, in a personal approach of emotional support
- To support a third party, as part of a professional activity (for example, a practitioner guiding clients through exposure situations)
Each User is responsible for their use of the Service. The Service is not intended to diagnose, prevent or treat mental illness. If there is any doubt about the suitability of the Service for their situation, the User is invited to consult a healthcare professional.
The necessary equipment (VR, tablet, web browser) is specified at the time of Subscription.
7. Provision of equipment
Certain Subscription plans may include the provision of a virtual reality headset and its accessories. This material remains the property of C2Care for the duration of the subscription.
At the end of the commitment, the User undertakes to return the equipment within 14 calendar days, complete, functional and in its original packaging, using the return label provided.
In the event of non-return, damaged or incomplete equipment, replacement costs may be invoiced to the User, according to a scale available on request.
The equipment is covered by warranty only during the commitment period. Outside this period, in the event of a malfunction, the return costs are the responsibility of the User and C2Care does not undertake to repair or replace the equipment.
8. Remote sessions with a practitioner
Two methods of use are provided:
(a) Free sessions between Users
A User can offer sessions to another User (for example, a practitioner supporting his clients via the C2Care solution). C2Care is neither a party to this relationship nor responsible for arranging appointments or any payments.
(b) Sessions offered by C2Care
Some Subscription plans include remote sessions with a Partner Practitioner C2Care. These sessions:
- Must be reserved by the User within the current monthly periodicity
- Are limited in monthly number (indicated at Subscription)
- Cannot be carried over or refunded from one month to the next
- Must be canceled at least 48 hours in advance
9. Pricing, payment and invoicing
The prices of the Services are indicated during Subscription, depending on the chosen plan and the location of the User. They can be expressed in different currencies depending on the country of residence or billing.
Payment is made by credit card via a secure platform. The Service is invoiced according to the selected frequency (monthly or annual), with the issuance of an electronic invoice sent to the User.
Access to the Service without financial compensation does not result in any billing, except in the case of switching to a paid plan. Any change to a paid plan implies the immediate application of the pricing conditions in force at the time of the change.
C2Care can adjust its prices at any time, without retroactivity. Price changes are applicable to new Subscriptions and when renewing existing subscriptions.
10. Right of withdrawal
The User has a right of withdrawal of 14 days from the date of Subscription, provided that:
- Not having used the Service
- Not having booked a session with a Partner Practitioner
The request is made in writing to sales@c2.care. In the event of exercising the right of withdrawal and in the context of making equipment available, the User must return the complete, unopened equipment at his own expense. C2Care will issue a refund within 14 days.
11. Intellectual property
All content, software, environments and brands linked to the Service are the exclusive property of C2Care. Any reproduction, distribution, adaptation or use outside the framework of the Service is prohibited without prior written authorization.
12. Personal data and confidentiality
C2Care pays particular attention to the protection of personal data. The processing of collected data is carried out in accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) for Users located in the European Economic Area.
For Users residing outside the European Union, C2Care applies the confidentiality and security principles defined by the GDPR as data processing standards, unless otherwise required by local legislation.
The User may, at any time, request access, rectification or deletion of their personal data via the site's contact form. No information will be shared with third parties without prior consent.
Exchanges between Users and Partner Practitioners are strictly confidential and are not subject to any recording.
13. Use of artificial intelligence
The use of C2Care Services involving artificial intelligence functionalities is governed by both the AI Use Charter and a dedicated Information Notice.
The interactions (AI coach, virtual characters, etc.) are autonomous, non-medical and respect the principles of security, transparency and confidentiality. The User retains control of their data and can consult the IA Charter as well as the IA Information Notice at any time.
By accepting these General Conditions of Sale and Use, the User acknowledges having read the Information Notice relating to Artificial Intelligence, accessible at the following address: https://c2.care/AI-Notice-EN.pdf, and accepts without reservation its content, in particular the limits of use, precautions, confidentiality guarantees and the non-medical nature of the tools offered.
14. Evolution of the Service and updates
C2Care may modify the content, functionality or access to the Services at any time without notice. This includes adding or removing virtual environments, or adapting to technological developments.
The minimum hardware requirements are specified at the time of Subscription and may change.
15. Responsibility and limits
The Service offered by C2Care aims to support emotional well-being. It constitutes neither a medical procedure, nor a therapy, nor an emergency solution, and can in no case replace follow-up provided by a healthcare professional.
In the event of temporary interruption, malfunction or partial or total unavailability of the Service, C2Care cannot be held responsible for any consequences for the User. No compensation or financial compensation will be due in this regard. C2Care will endeavor to restore access to the Service as soon as possible.
The User is solely responsible for his use of the Service, whether he accesses it with or without financial compensation.
C2Care declines all liability in the event of:
- Misuse of the Service or use not in accordance with its purpose
- Lack of consultation with a health professional if necessary
- Psychological, emotional or physical consequences resulting from exposure to immersive environments
The Service does not allow us to respond to critical or urgent situations. In the event of an emergency or distress situation, it is the User's responsibility to immediately contact the competent emergency services in their country of residence (local emergency number or health service).
16. Force majeure
Neither party can be held responsible in the event of non-performance of its obligations due to a case of force majeure as recognized by French case law.
17. Applicable law and disputes
These General Terms and Conditions are subject to French law. Any dispute relating to their interpretation or execution will fall under the exclusive jurisdiction of the Court of Toulon, France.
